Terms of Use

These Terms of Use ("Terms") govern your use of the Get Chalked mobile application (the "App") provided by Hooked on Yutz ("we," "us," or "our") on iPhone and on Android. By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy.

1. Licence grant

Hooked on Yutz grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Remove any proprietary notices or labels
• Use the App for any commercial purpose without written permission
• Use automated means to extract data from our services

2. Subscription terms

Get Chalked is an annual auto-renewing subscription, purchased through the Apple App Store or Google Play. All features are included; there are no tiers and no additional purchases.

• Payment is charged to your store account at confirmation of purchase
• The subscription renews automatically each year unless cancelled at least 24 hours before the end of the current period
• Manage or cancel it in your store account's subscription settings at any time
• Refunds are handled by Apple or Google under their store terms; we cannot issue them directly
• The current price is shown in the App before you purchase. Prices are subject to change; existing subscribers are notified as the store requires

Losing access at the end of a subscription does not delete anything you added. It stays on your device.

3. Score data

The App displays gymnastics scores aggregated from publicly available sources. This data consists of facts — scores, dates, names — that are not copyrightable.

Accuracy: we strive for accuracy but cannot guarantee it. Scores depend on meets posting results correctly. We are not responsible for errors, omissions or delays.

Availability: score availability depends on third-party sources. We cannot guarantee that scores for every meet or athlete will be available.

4. Accounts

You must be at least 13 to create an account. An account holds an email address and syncs what you add to our servers, and we do not knowingly create one for anyone younger. This is about who the account belongs to, not who can be followed — the gymnasts in the App are public competition results.

Syncing requires an account, created with an email address and password. You are responsible for keeping your password secure and for activity under your account. You may use the App without an account, in which case everything you add stays on your device and nothing syncs.

You can delete your account from inside the App at any time. Deletion is permanent: your data is removed from our servers and cannot be recovered by us or by you.

5. Your content

Notes, tags, photos, manual meets, résumé fields and trips you create ("Your Content") remain your property. We claim no ownership of it. You grant us only the permission needed to run the service for you: to store Your Content if you sign in, sync it between your devices, and restore it when you ask. We do not combine it with other users' data and we do not sell it. If you share a card or a résumé, you are responsible for having the right to share what is on it, including photographs of other people.

Keep your own copies. We take reasonable care with your data but are not liable for its loss.

6. User conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorised access to any part of the App or our services
• Interfere with or disrupt the App's operation
• Use automated systems (bots, scrapers) to access the App or our services
• Use the App to harass, stalk, or harm any person

7. Intellectual property

The App, including its design, code, graphics and features (but excluding publicly available factual score data), is owned by Hooked on Yutz and protected by intellectual property laws. The "Get Chalked" name, logo and branding are trademarks of Hooked on Yutz.

8. Disclaimer of warranties

We do not warrant that:

• The App will be uninterrupted or error-free
• Score data, rankings, projections or insights will be accurate or complete
• Notifications will arrive at any particular time, or at all
• Any errors will be corrected

Rankings, trends and "within reach" figures are derived from posted scores. They are information, not advice about training, competition or recruiting.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOKED ON YUTZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES arising out of or related to your use of the App, including loss of data, errors or omissions in score data, service interruptions, or any action taken based on information in the App.

Our total liability for any claim shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Hooked on Yutz and its officers, employees and agents from any claims, damages or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App. Everything you added stays on your device.

12. Dispute resolution

Arbitration agreement: any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association, rather than in court.

Class action waiver: you agree to resolve disputes only on an individual basis and waive any right to participate in class actions.

Opt-out: you may opt out of this arbitration agreement by sending written notice to the address below within 30 days of first using the App.

13. General

Governing law: these Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.

Entire agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and Hooked on Yutz regarding the App.

Severability: if any provision is found unenforceable, the remaining provisions remain in effect.

Changes: we may modify these Terms. If a change materially affects your rights, we will tell you in the App before it takes effect. Continued use after that constitutes acceptance.
